Exempt purpose: The Seventh Generation Fund, LLC ("Fund") was established to create educational opportunities that enable each member of the Ute Indian Tribe of the Uintah & Ouray (the "Tribe") to maximize his or her potential and become a self sufficient, productive contributor to the traditions and customs of the Tribe. The Fund seeks to accomplish this purpose by (1) providing higher education scholarships for members of the Tribe, (2) developing innovative tribal educational programs, and (3) promoting and facilitating the preservation and development of the Tribal language and culture (each of these programs is explained in more detail in I through III below). The Fund's exempt purpose activities will consume more than 80% of its resources, including time spent on Fund matters. The remainder of the Fund's resources will be used for administrative expenses.

The Fund's activities will be administered by the Tribal Education Department (the "Education Department") and supervised by the Tribal Business Committee (the "Business Committee"). The Education Director, as appointed and hired by the Business Committee, is responsible for the day-to-day administration of the Fund


Following are the charitable programs that will be administered by the Fund:
  1. Scholarships for Higher Education:
    1. The Education Department will award scholarships to enrolled members of the Tribe and, when available, enrolled members of other federally recognized Indian Tribes. The scholarships enable recipients to continue their education beyond high school for purposes of developing leadership, tribal talent, individual careers and broad employment opportunities.
    2. Awards will commence following the receipt of a determination letter from the Internal Revenue Service ("Service") regarding this application.
    3. Scholarships will be awarded to applicants approved by the Education Department in accordance with the Seventh Generation Fund, LLC Scholarship Program Policies and Procedures (see Exhibit C). Scholarships will be administered by the Education Department with oversight by the Business Committee in Ft. Duchesne, Utah.

  2. Development of Innovative Educational Programs for the Tribe:
    1. The Education Department will participate in the development of innovative educational programs and curricula that foster a supportive learning environment and emphasize the importance of education within the Tribe. Such programs and curricula will serve Tribe members of all ages. Specifically, the Fund would support projects such as the development of Uintah River High School, a Utah state licensed charter high school that seeks to address the dropout rate of Tribe students and enable each student to read and comprehend at or above grade level. Additionally, the Fund would support adult education programs ranging from family literacy to parenting skills.
    2. Fund participation in the development of such education programs will commence prior to the receipt of a determination letter from the Service regarding this application.
    3. Participation in and support of the development of innovative educational programs will be conducted as the Education Department determines appropriate, subject to the supervision of the Business Committee. The programs will be administered in Ft. Duchesne, Utah.

  3. Preservation and Development of the Tribe's Language and Culture:
    1. The Fund will support the creation of tribal programs designed to preserve and develop Tribal linguistic and cultural traditions. Specifically, the Business Committee and the Education Department would support projects such as the creation of a Tribal language dictionary. The Business Committee and the Education Department also hope to renew the tribal dance, music and film-making classes that the Tribe once provided but has been unable to continue due to a lack of funds.
    2. Fund participation in the development of such linguistic and cultural programs will begin prior to the receipt of a determination letter from the Service regarding this application.
    3. The Education Department will determine which programs it wishes to create or support, subject to oversight by the Business Committee. The programs will be administered in Ft. Duchesne, Utah.
